Four Reasons Why Bail May Be Denied

1. The Severity of the Crime. A major reason a judge may deny bail is that the crime is very serious. If the accusation involves murder or rape, these are crimes where bail may be denied. The judge may allow bail later if there is evidence that the crime wasn’t severe, but usually, offenders must stay in jail to wait for trial in serious cases. 

2. Past Offenses. If you have a record of committing a crime or are on parole, this will affect the decision the judge makes. If you have committed previous offenses, it is likely that the judge will not allow you to be eligible for bail.

3. Citizenship. If someone gets arrested and the courts find out they are not legally a citizen, they will most likely not be allowed bail. If the individual is not documented, it is likely they will be deported on top of their arrest.

4. Disrespectful in Court. Any disrespectful act like yelling at the judge can lead to bail being denied.
